(1) Without the consent of the principal, the commercial employee may neither carry on a commercial business nor conduct transactions in the principal's branch of commerce for their own account or that of another.
(2) Consent to carry on a commercial business is deemed to be granted if the principal, at the time of hiring the employee, is aware of the employee’s business and does not expressly stipulate in the agreement that they give it up.
