(1) Whoever acquires an existing commercial business inter vivos or mortis causa may carry on the business under the existing business name, with or without appending an addition indicating successorship, even if it includes the name of the former business owner, provided that the former business owner or their heirs expressly consent to the continuation of the business name.
(2) Where a commercial business is taken over on the basis of a usufructuary right, a leasehold agreement, or a similar relationship, these provisions apply accordingly.
