(1) The carrier is obliged by the contract of carriage to carry the goods to their destination and to deliver them there to the consignee.
(2) The sender is obliged to pay the agreed freight.
(3) The provisions of this Subdivision apply whenever
1. the goods are to be carried over land, on inland waterways or by aircraft, and
2. the carriage is part of the operation of a commercial enterprise.
If the nature or size of the enterprise is such that it does not require a commercially organised business operation, and if the name of the enterprise is not registered in the Commercial Register in accordance with section 2, then the provisions of Division 1 of Book 4, to the exception of sections 348 to 350, apply to the freight business as a subsidiary source of law.
