A commercial enterprise, the commercial operation of which is not already a commercial business in accordance with section 1 (2), is deemed to be a commercial business within the meaning of this Code if the business name of the enterprise is registered in the Commercial Register. The trader is entitled, but not obliged, to effect registration pursuant to the provisions in force for the registration of commercial business names. If such registration has been effected, the business name also may be deleted upon application of the trader, unless the pre-requisite laid down in section 1 (2) has been fulfilled in the meantime.
