Notice by publication of the entries; register notices by publication

(1) The entries in the Commercial Register as well as the register notices by publication defined in subsection (3) are published by their first becoming retrievable via the electronic information and communication system defined in section 9 (1). Section 9 (1) sentences 4 and 5 applies accordingly.

(2) The entries in the Commercial Register and the documents submitted that are subject to unrestricted inspection in accordance with section 9 are to be made available, without undue delay following their entry in the Commercial Register, for retrieval via the electronic information and communication system defined in section 9 (1).

(3) In the cases defined by law, the court of registration may publish other or additional facts in the electronic information and communication system defined in section 9 (1) (register notices by publication).

(4) An entry is considered published upon midnight of the day on which it was made, and a register notice by publication is considered published upon midnight of the day on which the register notice by publication was made. This does not apply if proof is provided that the retrieval of the entry or of the register notice by publication

1.  had been possible already at an earlier point in time or

2.  became possible only at a later point in time.
