Section 74c

(1) The commercial employee must allow to be deducted from the compensation due all such amounts as, during the period for which compensation is to be paid, they earn or, acting in bad faith, fail to earn, through utilisation of their working capacity elsewhere, to the extent that the compensation plus such amounts would exceed the contractual remuneration last received by them by more than one tenth. If, in consequence of the non-compete clause, the employee is forced to change their residence, the amount of one tenth will be replaced by one quarter. The employee may not claim compensation for any period in which they are serving a prison sentence.

(2) The employee is obliged, upon request, to furnish information to the principal as to the amount of their earnings.
