Section 74

(1) An agreement between the principal and the commercial employee which, after the employment relationship has terminated, restricts the employee in their business activities (non-compete clause) requires the written form and is to be handed over to the employee as a document signed by the principal containing the agreed stipulations.

(2) The non-compete clause will be binding only if the principal enters into obligation to pay for the period of prohibition a compensation that for each year of the prohibition amounts to at least half of the most recent contractual remuneration received by the commercial employee.
