(1) A commission agent is a person who undertakes, on a commercial basis, to buy or sell goods or securities in their own name for the account of another (the principal).
(2) The provisions of this Division also apply if the commission agent’s enterprise, by reason of its nature or size, does not require a commercially organised business operation and the business name of the enterprise is not registered in the Commercial Register as stipulated in section 2. In this case, the provisions of Division 1 of Book 4, to the exception of sections 348 to 350, also apply with regard to the commission transaction.
