Section 30

(1) Every new business name must be clearly distinguishable from all other business names already existing in the same place or in the same municipality and already registered in the Commercial Register, Register of Cooperatives, Register of Companies, Register of Partnerships or Register of Associations.

(2) If a merchant has the same forename and the same surname as an already registered merchant and also wishes to use these names as their business name, then they must append an addition to the business name so as to make it clearly distinguishable from the already registered business name.

(3) If the same business name already is registered in the place or in the municipality where a branch office is to be established, then the business name of the branch office must include an addition in accordance with the stipulation made in subsection (2).

(4) The Land governments may determine that neighbouring places or municipalities are to be considered as one place or one municipality within the meaning of these provisions.
