(1) The obligation to tolerate the right of way of necessity does not arise if the previous connection of the plot of land with the public road is ended by an arbitrary act of the owner.
(2) If, as a result of the alienation of part of the plot of land, the part alienated or the part retained is cut off from the connection with the public road, the owner of the part over which the connection was previously made is to tolerate the right of way of necessity. The alienation of one part is equivalent to the alienation of one of several plots of land belonging to the same owner.
