(1) In the case of an instruction to assume a debt, the instructed party is released from the debt by making payment in the amount of the debt.
(2) The instructed party is not under a duty to the instructing party to accept the instruction or to perform by paying the recipient of the document setting out the instruction merely because the instructed party is the debtor of the instructing party.
