(1) The debtor may refuse to satisfy the equalisation claim to the extent that in the circumstances of the case, the equalisation of accrued gains would be grossly inequitable.
(2) Gross inequity may be given in particular if the spouse who achieved the smaller amount of accrued gains for a long period of time culpably failed to discharge their financial duties arising from the marital relationship.
