Direct substitution

(1) Whatever is acquired on the basis of a right that is part of the common matrimonial property or as compensation for the destruction of an object forming part of the common matrimonial property, its damage or the deprivation of its possession, or whatever is acquired by a legal transaction that relates to the common matrimonial property, becomes common matrimonial property.

(2) If a claim that is acquired by legal transaction is part of the common matrimonial property, the debtor need not allow this to be asserted against them until they become aware that the claim is part of the common matrimonial property; the provisions of sections 406 to 408 are to be applied accordingly.
