Information obligations towards supervisory authorities

(1) The depositary must make available to the Federal Institute, the competent authorities of the AIF, and the competent authorities of the AIF management company, on request, all information that it has received in the course of performing its duties.
(2) Where the Federal Institute is not the competent authority of the AIF or of the AIF management company, the Federal Institute makes available to the competent authorities of the AIF and of the AIF management company, without delay, all information relevant to the exercise of the supervisory powers of these authorities. Where the Federal Institute is not the competent authority of the depositary, the Federal Institute makes available to the competent authorities of the depositary, without delay, all information relevant to the exercise of the supervisory powers of these authorities.
