(1) All publications and promotional materials relating to units or shares in an AIF marketed to retail investors, or in a domestic UCITS, must be drawn up in German or accompanied by a German translation. The German wording of the documents named in section 297(1) to (4) and (8), and of the documents and publications named in the first sentence, is authoritative.
(2) For EU UCITS, the German wording of the key investor information is authoritative for prospectus liability under section 306; for the other documents named in section 298(1), the language version published within the scope of this Act is to be used as the basis. Where publication also takes place in German, the German wording is authoritative.
(3) Translations of key investor information and of documents under section 298(1), first sentence, and under section 299(1), first sentence, must be prepared under the responsibility of the foreign AIF management company or the EU management company. They must correctly and completely reproduce the content of the original information.
