Section 229

Investment conditions

(1) The investment conditions of AIF capital management companies managing funds of hedge funds must contain the particulars under section 162.
(2) In addition to section 162(2), point 1, AIF capital management companies must state
1. the principles according to which the target funds in which they invest are selected,
2. that these target funds are hedge funds, EU AIF, or foreign AIF whose investment policy is in each case subject to requirements comparable to those under section 283,
3. what investment strategies these target funds follow and to what extent, as part of their investment strategies, they may raise loans, use securities loans or derivatives, and carry out short sales to generate leverage,
4. up to what amount funds may be invested in bank balances, money market instruments, and units or shares in domestic AIF, EU AIF, or foreign AIF under section 225(2), first sentence, and
5. whether the assets of a target fund are held in custody by a depositary or a prime broker.
(3) In addition to section 162(2), point 4, AIF capital management companies managing funds of hedge funds must state all requirements and conditions for the return and payment of units from the fund of hedge funds concurrently against return of the units.
