Permitted assets, investment limits

(1) The capital management company may acquire, for an infrastructure collective investment fund, only: 1. participations in infrastructure project companies, 2. properties, 3. securities, 4. money market instruments, 5. bank balances, 6. investment units under section 196, where the investment funds in which units are held invest exclusively in bank balances and money market instruments, and 7. assets in accordance with subsection (7).
(2) The capital management company must ensure that 1. the proportion of participations in infrastructure project companies held for the account of the infrastructure collective investment fund does not exceed 80 percent of the value of the collective investment fund, and 2. no more than 10 percent of the value of an infrastructure collective investment fund is invested in a single infrastructure project company.
(3) The capital management company must ensure that no more than 30 percent of the value of the infrastructure collective investment fund is invested in properties and rights.
(4) The capital management company must ensure that the proportion of participations in infrastructure project companies, properties, and usufructuary rights over land held for the account of the infrastructure collective investment fund amounts to at least 60 percent of the value of the collective investment fund.
(5) The capital management company must ensure that no more than 20 percent of the value of the infrastructure collective investment fund is invested in securities within the meaning of section 193(1), points 1, 5, and 6.
(6) The capital management company must ensure that the proportion of assets held for the account of the infrastructure collective investment fund under subsection (1), points 4 to 6, amounts to at least 10 percent of the value of the collective investment fund.
(7) Transactions having derivatives as their subject matter may be carried out only to hedge assets held in the infrastructure collective investment fund against a loss of value.
