(1) Section 169 applies with the proviso that the valuation guidelines for real estate collective investment funds must additionally provide that
1. the assets within the meaning of section 231(1), first sentence, points 1 to 6, are valued by two external valuers independent of each other, satisfying the requirements of section 216(1), first sentence, point 1, and second sentence, and (2) to (5), and valuing the assets independently of each other, and
2. the external valuers within the meaning of point 1 carry out property inspections.
(2) The AIF capital management company or the real estate company must contractually oblige the real estate company in which it is participated
1. to submit statements of assets monthly to the AIF capital management company and the depositary, and
2. to have the statements of assets audited once a year on the basis of the annual financial statements of the real estate company bearing an auditor's certificate.
(3) The value of the participation in a real estate company determined on the basis of the statements of assets must be used as the basis for the valuations for ongoing price determination.
