Section 118

Company name and additional notices in legal transactions

(1) By way of derogation from section 4 of the Stock Corporation Act, the company name of an investment stock corporation with variable capital must contain the designation "Investmentaktiengesellschaft" [investment stock corporation] or a generally understandable abbreviation of this designation; a notice of the variability of the share capital must also be given on all business letters within the meaning of section 80 of the Stock Corporation Act. The company name of an investment stock corporation with sub-funds must additionally contain the suffix "mit Teilgesellschaftsvermögen" [with sub-funds] or a generally understandable abbreviation of these designations.
(2) Where the investment stock corporation with sub-funds acts in legal transactions only for one or more sub-funds, it must disclose this and draw attention to the separation, in terms of liability, of the sub-funds.
