(1) The investment conditions or the articles of association of the development promotion fund must provide that the management of the fund by the AIF capital management company is terminated with six months' notice where, in two consecutive reviews under section 28a(1) in conjunction with Principle 9 of the Operating Principles for Impact Management, a material infringement by the AIF capital management company of the Operating Principles for Impact Management is found.
(2) In the case of termination under subsection (1), the right of management may be transferred to another AIF capital management company within the notice period.
(3) Where the AIF capital management company has delegated the portfolio management for a development promotion fund, or is advised with regard to its portfolio management, the investment conditions or the articles of association of the fund must provide that the legal relationship with the delegate or adviser undertaking is terminated by the capital management company with six months' notice where, in two consecutive reviews under section 28a(2) in conjunction with Principle 9 of the Operating Principles for Impact Management, a material infringement by the delegate or adviser undertaking of the Operating Principles for Impact Management is found.
