(1) By way of derogation from section 19(1), point 3, of the Commercial Code, the company name of the open-ended investment limited partnership must contain the designation "offene Investmentkommanditgesellschaft" [open-ended investment limited partnership] or a generally understandable abbreviation of this designation.
(2) The company name of an open-ended investment limited partnership with sub-funds must additionally contain the suffix "mit Teilgesellschaftsvermögen" [with sub-funds] or a generally understandable abbreviation of this designation. Where the investment limited partnership acts in legal transactions only for one or more sub-funds, it is obliged to disclose this and draw attention to the separation, in terms of liability, of the sub-funds.
