Publication of immediately enforceable measures

(1) The Federal Institute publicly announces, on its website, measures that are immediately enforceable under section 7, insofar as this is required, after weighing the interests concerned, to remedy or prevent irregularities. For measures that are not final, the following notice must be added: "This measure is not yet final." Where an appeal has been lodged against the measure, the status and outcome of the appeal proceedings must be published.
(2) The Federal Institute refrains from publication where publication would jeopardise the stability of the financial markets or ongoing investigations.
(3) The publication may contain personal data only to the extent necessary for the purpose of remedying or preventing irregularities. The publication must be deleted as soon as it is no longer necessary, but at the latest after five years.
