Exchange of information with the Deutsche Bundesbank

(1) The Federal Institute and the Deutsche Bundesbank must communicate to each other observations and findings that are necessary for the performance of their respective tasks.
(2) The Federal Institute must make available to the Deutsche Bundesbank, in particular, the information and documents under 1. section 19(1), first and second sentences, and (5), also in conjunction with section 108(3), 2. section 34(3), points 3, 4, and 7 to 11, and (4), sections 35, 38(1), second sentence, and (4), second sentence, 3. section 49(1) and (4), first sentence, section 53(2) and, insofar as it concerns a change to the particulars named in section 53(2), section 53(5), 4. section 68(7), fourth sentence, 5. section 121(3), fourth sentence, also in conjunction with section 148(1), first sentence, section 159, second sentence, insofar as internal capital management companies were examined, 6. section 114, first sentence, section 130, first sentence, section 145, first sentence, section 155, first sentence, 7. section 200(4).
(3) The Deutsche Bundesbank must make available to the Federal Institute, in particular, the particulars it obtains from statistical surveys under section 18 of the Act on the Deutsche Bundesbank. It must consult the Federal Institute before ordering such a survey; section 18, fifth sentence, of the Act on the Deutsche Bundesbank applies correspondingly.
(4) The Federal Institute and the Deutsche Bundesbank regulate, by mutual agreement, the details of the forwarding of the observations, findings, information, documents, and particulars within the meaning of subsections (1) to (3).
(5) The exchange of information under subsections (1) to (3) includes the transmission of the personal data necessary for the receiving body to perform its tasks. To perform their tasks, the Federal Institute and the Deutsche Bundesbank may agree that they may each retrieve, in an automated procedure, the data respectively stored by the other body. In other respects, section 7(4) and (5) of the Banking Act applies correspondingly.
