Representation of the company, venue for the marketing of EU AIF or foreign AIF to retail investors

(1) The representative represents the EU AIF or foreign AIF in and out of court. It is authorised to receive documents intended for the foreign AIF management company and the marketing company. These powers may not be restricted.
(2) For actions against an EU AIF or a foreign AIF, an AIF management company, or a marketing company, relating to the marketing of units or shares in EU AIF or foreign AIF to retail investors within the scope of this Act, the court in whose district the representative has its residence or seat has jurisdiction. This venue may not be excluded by agreement.
(3) The name of the representative, and the ending of its position, must be published by the Federal Institute in the Federal Gazette. Where costs are incurred by the Federal Institute as a result of the publication under the first sentence, these costs must be reimbursed to it.
