Section 40b

Rights and obligations of the special representative

(1) Within the framework of his or her tasks, the special representative is entitled to 1. request information and the production of documents from the members of the supervisory bodies, the managers, and the employees of the capital management company, 2. take part, in an advisory capacity, in all meetings and gatherings of the supervisory bodies and other committees of the capital management company, 3. enter the business premises of the capital management company, 4. inspect its business papers and books, and make enquiries. The managers and members of the supervisory bodies must support the special representative in the performance of his or her tasks.
(2) The special representative is obliged to provide the Federal Institute with information on all findings made in the course of his or her activity.
