Section 223

Special provisions on the issue and redemption of units or shares

(1) The investment conditions of Other Investment Funds may, by way of derogation from section 98(1) or section 116(2), first sentence, provide that units or shares are redeemed no more than once every six months and at least once a year, on a date determined in the investment conditions, where, at the time of the return of the units or shares, the sum of the values of the units or shares returned exceeds an amount determined in the investment conditions. In the cases under the first sentence, the investment conditions must provide that the return of a unit or of shares must take place by way of an irrevocable redemption declaration to the AIF capital management company, subject to compliance with a notice period of at least one month and at most twelve months; section 227(3) applies correspondingly.
(2) In the cases under section 222(1), section 98(1) or section 116(2), first sentence, applies with the proviso that the investment conditions must provide that units or shares are redeemed only on particular redemption dates, but no more than once a quarter and at least once a year. The return of units or shares is permissible only by way of an irrevocable redemption declaration, subject to compliance with a notice period of between one month and 24 months; section 227(3) applies correspondingly.
