Performance of functions by third parties

(1) Where a provider of benefits, an association of providers of benefits, or a working group may have functions performed by a third party, it must be ensured that the third party offers a guarantee of a proper performance of the functions that safeguards the rights and interests of the person concerned. Insofar as functions from the field of social insurance are to be performed by a third party in which a provider of benefits, an association or a working group directly or indirectly participates, the provider of benefits, the association or the working group must oblige the third party to submit to the principal, on demand, all documents, and to provide information on all facts, required to exercise the right of supervision over the principal, on the basis of a due examination by the principal's supervisory authority. The supervisory authority must be informed by the provider of benefits, the association or the working group so timely and comprehensively that it retains sufficient time to examine this before the transfer of the function or a change. The supervisory authority may dispense with being informed. The third and fourth sentences do not apply to the Federal Employment Agency.
(2) Section 89(3) to (5), section 91(1) to (3), and section 92 apply correspondingly.
