Transmission for the protection of internal and external security

(1) Transmission of social data is permissible insofar as it is required in the individual case for the lawful performance of the functions falling within the competence of the authorities for the protection of the constitution, the Federal Intelligence Service, the Military Counter-Intelligence Service and the Federal Criminal Police Office. Transmission is limited to particulars of surname and first name and formerly held names, date of birth, place of birth, current and former addresses of the person concerned, and names and addresses of his or her current and former employers.
(2) The necessity of the request for transmission is decided by a person appointed by the head of the requesting body, who should have the qualification for judicial office. Where a supreme federal or Land authority is competent for supervising the requesting body, it must be informed of the requests for transmission made. At the requested body, the decision on the request for transmission is taken by the head of the authority or his or her general deputy.
