(1) Where a provider of benefits requests another provider of benefits to net a claim against an arrears payment, and cannot yet determine the amount of the claim to be netted, while the requested provider of benefits is already able to make the arrears payment, the arrears payment must be made at the latest within two months of receipt of the netting request. Insofar as the arrears payment, in the view of the providers of benefits involved, exceeds the claims of the requesting provider of benefits, it must be paid out without delay.
(2) Where a claim to a monetary benefit has passed to another provider of benefits, and the passing of the claim is known both to that provider and to the provider of benefits obliged to pay, the provider of benefits obliged to pay must pay the monetary benefit to the person entitled after the expiry of two months from the point in time at which payment is earliest possible, insofar as it is not known to it, by that point in time, in what amount the claim vests in the other provider of benefits. Payment has a discharging effect as against the other provider of benefits. Subsection (1), second sentence applies correspondingly.
