Order of priority among several persons entitled to reimbursement

(1) Where a provider of benefits is liable to reimburse several providers of benefits, the claims are to be satisfied in the following order of priority: 1. (repealed); 2. the claim of the provider of benefits rendering provisional benefits under section 102; 3. the claim of the provider of benefits whose duty to render benefits has subsequently lapsed, under section 103; 4. the claim of the provider of benefits obliged to render benefits only subsidiarily, under section 104; 5. the claim of the incompetent provider of benefits, under section 105.
(2) Where claims of providers of benefits of equal rank concur, they are to be satisfied proportionately. Where several providers of benefits assert claims under section 104, the one that, in the relationship among the subsidiary providers of benefits themselves, would have a reimbursement claim under section 104, is to be satisfied first.
(3) The person liable to reimburse need not, in total, reimburse more than he or she would individually have had to render under the reimbursement provisions applicable to him or her.
