Repeat application

(1) Where a person entitled to benefits has refrained from making an application for a social benefit because a claim to another social benefit had been asserted, and that benefit is refused or must be reimbursed, the application now made subsequently has retroactive effect for up to one year, where it is made within six months of the expiry of the month in which the refusal or reimbursement of the other benefit became binding. The first sentence also applies where the application for the social benefit first asserted is withdrawn.
(2) Subsection (1) also applies where the timely application for another benefit was omitted through lack of knowledge of the conditions for the claim to it, and the second benefit would, had it been rendered, have ranked below the first benefit.
