(1) The physician or a member of another healthcare profession is obliged to give the provider of benefits information, on demand, in the individual case, insofar as this is required for carrying out its functions under this Code and 1. it is statutorily permitted; or 2. the person concerned has consented in the individual case. The consent should, as proof within the meaning of Article 7(1) of Regulation (EU) 2016/679 that the person concerned has consented to the processing of his or her personal data, be given in writing or electronically. The first and second sentences apply correspondingly to hospitals and to preventive-care or rehabilitation institutions.
(2) Information on questions whose answer would expose the physician, the member of another healthcare profession, or persons close to them (section 383(1), nos. 1 to 3 of the Code of Civil Procedure), to the danger of being prosecuted for a criminal offence or a regulatory offence, may be refused.
