Cross-border retrieval of proof

(1) The competent authority may retrieve, in automated fashion, from an authority of another Member State of the European Union, proof under Article 14(2) of Regulation (EU) 2018/1724 of the European Parliament and of the Council of 2 October 2018 establishing a single digital gateway to provide access to information, to procedures and to assistance and problem-solving services and amending Regulation (EU) No 1024/2012 (OJ L 295, 21.11.2018, p. 1), where this is required for the performance of its functions for one of the procedures under Article 14(1) of Regulation (EU) 2018/1724.
(2) Automated transmission of proof under Article 14(2) of Regulation (EU) 2018/1724 to an authority of another Member State of the European Union is permissible where that authority is competent and the transmission is required for the performance of its functions for one of the procedures under Article 14(1) of Regulation (EU) 2018/1724.
(3) Intermediary platforms may be used in the processing under subsections (1) and (2).
