Parties

(1) Parties are 1. applicants and respondents; 2. those to whom the authority intends to address, or has addressed, the administrative act; 3. those with whom the authority intends to conclude, or has concluded, a public-law contract; 4. those who have been joined to the procedure by the authority under subsection (2).
(2) The authority may, on its own initiative or on application, join to the procedure as parties those whose legal interests may be affected by the outcome of the procedure. Where the outcome of the procedure has a right-shaping effect for a third party, that party must, on application, be joined to the procedure as a party; insofar as the third party is known to the authority, it must notify the third party of the commencement of the procedure.
(3) A person who must be heard, without the conditions of subsection (1) being met, does not thereby become a party.
