Medical examinations, psychological aptitude examinations

(1) Where a provider of benefits arranges a medical examination measure or a psychological aptitude examination measure to establish whether the conditions for a social benefit are met, the examinations should be carried out, and their results recorded, in such a way that they can also be used in examining the conditions for other social benefits. The scope of the examination measure is governed by the function that the provider of benefits that arranged the examination has to perform. The examination findings should be used in establishing whether the conditions for another social benefit are met.
(2) The providers of benefits must ensure, by agreements, that examinations are dispensed with insofar as usable examination results already exist. For the individual case, and, where possible, for a multiplicity of cases, the providers of benefits must agree that, in assessing the conditions for social benefits, examinations are carried out on uniform and comparable bases, standards and procedures, and the results of the examinations recorded. They may further agree that the scope of the examination measure is governed by the functions of the providers of benefits involved; insofar as the examination measure is thereby extended, the consent of the person concerned is required.
(3) The formation of a central file of several providers of benefits for data of medically examined benefit recipients is not permissible.
