Claims against the employer

(1) Insofar as the employer does not satisfy the employee's claim to remuneration, and a provider of benefits has as a result rendered social benefits, the employee's claim against the employer passes to the provider of benefits up to the amount of the social benefits rendered.
(2) The passing of the claim is not excluded by the fact that the claim cannot be assigned, pledged or attached.
(3) In place of the employee's claims to benefits in kind, in the case of subsection (1) the claim to money takes their place; the amount is determined by the values of benefits in kind fixed under section 17(1), first sentence, no. 4 of the Fourth Book.
