Scope of application

(1) The provisions of this Part apply to the public-law administrative activity of the authorities that is exercised under this Code. For the public-law administrative activity of the authorities of the Länder, the municipalities and associations of municipalities, and the other legal persons under public law subject to the supervision of a Land, in executing special parts of this Code that become part of the Social Code after the provisions of this Part enter into force, this applies only insofar as those special parts, with the consent of the Bundesrat, declare the provisions of this Part applicable. The provisions do not apply to the prosecution and sanctioning of regulatory offences.
(2) An authority within the meaning of this Code is any body that performs functions of public administration.
