Discussion hearing

(1) After expiry of the period for objections, the plan approval authority may hold a discussion hearing, where the objections raised or the comments submitted give occasion for this. The plan approval authority concludes the discussion within three months of the expiry of the period for objections and the authority participation.
(2) The plan approval authority gives public notice of a discussion hearing at least one week beforehand. The notice of the holding of a discussion hearing may be combined with the notice under section 73(3), first sentence.
(3) The subject of a discussion hearing is the objections of persons affected timely raised against the plan under section 73(2), first sentence, no. 1, the comments of associations timely submitted under section 73(2), first sentence, no. 2, and the comments of the authorities under section 73a on the plan. Subject to a different determination by the plan approval authority, the following are entitled to take part in the discussion hearing: 1. the developer of the project, 2. the authorities under section 73a, 3. the persons affected, and 4. those who have raised objections or submitted comments.
(4) The plan approval authority may replace the discussion, wholly or in part, by digital formats under section 27c. Section 27c(1), no. 2 applies with the proviso that the discussion hearing may be replaced by a video or telephone conference even without the consent of those entitled to take part. The plan approval authority informs, on its website, in the case of the second sentence, of the nature, extent and use of the digital formats.
(5) In other respects, the provisions on the oral hearing in the formal administrative procedure (section 67(2), nos. 1 and 4 and (3), and section 68) apply correspondingly to a discussion, with the exception of section 68(4), third sentence.
