(1) An applied-for approval is deemed granted after the expiry of a period fixed for the decision (fiction of approval), where this is ordered by legal provision and the application is sufficiently definite. The provisions on the finality of administrative acts and on the legal-remedy procedure apply correspondingly.
(2) The period under subsection (1), first sentence is three months, insofar as nothing different is determined by legal provision. The period begins with the receipt of the complete documents. It may be reasonably extended once, where this is justified by the difficulty of the matter. The extension of the period must be reasoned and communicated in good time.
(3) On demand, the occurrence of the fiction of approval must be certified in writing to the person to whom the administrative act would have had to be notified under section 41(1).
