Submission to immediate enforcement

(1) Every contracting party may submit to immediate enforcement from a public-law contract within the meaning of section 54, second sentence. In this the authority must be represented by the head of the authority, his or her general representative, or a civil servant who has the qualification for judicial office.
(2) To public-law contracts within the meaning of subsection (1), first sentence, the Federal Administrative Enforcement Act applies correspondingly where a contracting party is an authority within the meaning of section 1(1), no. 1. Where a natural or legal person governed by private law, or an association without legal capacity, intends to pursue enforcement in respect of a monetary claim, section 170(1) to (3) of the Code of Administrative Court Procedure applies correspondingly. Where enforcement is directed at compelling an act, toleration or omission against an authority within the meaning of section 1(1), no. 2, section 172 of the Code of Administrative Court Procedure applies correspondingly.
