Scope of application

(1) This Act applies to the public-law administrative activity of the authorities of 1. the Federation, of corporations, institutions and foundations under public law directly subject to the Federation, 2. the Länder, the municipalities and associations of municipalities, and the other legal persons under public law subject to the supervision of a Land, where they execute federal law on behalf of the Federation, insofar as provisions of federal law do not contain identical or conflicting provisions.
(2) This Act also applies to the public-law administrative activity of the authorities named in subsection (1), no. 2, where the Länder execute, as their own affair, federal law concerning matters of exclusive or concurrent federal legislation, insofar as provisions of federal law do not contain identical or conflicting provisions. For the execution of federal statutes enacted after this Act enters into force, this applies only insofar as the federal statutes, with the consent of the Bundesrat, declare this Act applicable.
(3) This Act does not apply to the execution of federal law by the Länder insofar as the public-law administrative activity of the authorities is governed by Land law through an administrative procedure act.
(4) An authority within the meaning of this Act is any body that performs functions of public administration.
