Powers of control

(1) Where the resolution conditions are satisfied, the resolution authority may, in order to take resolution action, assume control over the institution and group entities under resolution, either directly or through a special manager within the meaning of section 87, in order to 1. operate the institution or group entity under resolution with all the powers of the shareholders, the management, and the supervisory or administrative body of the institution under resolution, and to be able to provide the institution's activities and services, 2. manage the assets and property of the institution or group entity under resolution, and to be able to dispose of those assets and that property.
(2) The resolution authority and the special manager are not regarded as managers within the meaning of section 25c of the Banking Act, or as a supervisory or administrative body within the meaning of section 25d of the Banking Act.
