Part 4 · Resolution  ›  Division 2 · Transfer of Shares, Assets, Liabilities and Legal Relationships › Section 122

Participation of the resolution authority in permit, authorisation, or approval procedures of a foreign authority

(1) Where a legal act comparable to a resolution order is issued by a foreign resolution authority, and the effectiveness of the foreign legal act requires permits, authorisations, or approvals to be granted domestically, the resolution authority, after being informed by the foreign resolution authority or by a domestic institution or group entity, or on its own initiative, coordinates the procedures for granting such permits, authorisations, or approvals, acting as the single point of contact within the meaning of section 71a of the Administrative Procedure Act. Sections 71a to 71e of the Administrative Procedure Act apply; the resolution authority, acting as the single point of contact, is empowered to shorten or determine the time limits and deemed-receipt rules provided for therein or otherwise applicable.
(2) The resolution authority is not obliged to investigate which permits, authorisations, or approvals are required domestically.
(3) Where the resolution authority coordinates the procedure under subsection (1), a domestic authority may refuse the corresponding permit, authorisation, or approval only with the resolution authority's consent. Where a domestic authority does not decide within the period set by the resolution authority, the corresponding permit, authorisation, or approval is deemed granted. It may be withdrawn or revoked only with the resolution authority's consent.
