(1) In the event of a breach of the minimum requirement for own funds and eligible liabilities under section 49e or section 49f, the supervisory authority and the resolution authority may, within their respective competence, make use of their powers under sections 36, 58, 58a, 59, 60, 172 and 174, or section 45 of the Banking Act. The resolution authority or the supervisory authority may also, within their respective competence, assess under sections 62 to 64 and 77(6) whether the conditions of section 62(1), first sentence, point 1, are satisfied.
(2) The resolution authorities and the supervisory authorities inform one another of the exercise of their respective powers under subsection (1).
