(1) An unimpeded exchange of information takes place between the resolution authority and the supervisory authority in the context of mutual assistance, advice and coordination. Insofar as necessary for the performance of their respective tasks, they may request information from one another and must communicate observations and findings to one another. The first and second sentences also apply as between the resolution authority and the Deutsche Bundesbank, insofar as information is concerned that arose in the course of, or is required for, the ongoing supervision of institutions by the Deutsche Bundesbank. The first and second sentences also apply as between the resolution authority and the Federal Ministry of Finance, insofar as information is concerned that is required for the performance of the tasks incumbent on the Federal Ministry of Finance.
(2) The authorities, persons or bodies referred to in section 5(1) and (2) are entitled to pass information to one another, provided that receipt of the information is necessary for the performance of the tasks incumbent on them under this Act.
