(1) The resolution authority may require the undertakings and central counterparties referred to in section 1(1), the members of the governing bodies and the employees of those undertakings or central counterparties, or third parties to whom functions or activities of those undertakings or central counterparties have been outsourced, to provide information and to produce documents necessary for the resolution authority to perform its functions under this Act. The resolution authority may also require that the documents referred to in the first sentence be made available in copy.
(2) A person obliged to provide information may refuse to answer questions the answering of which would expose that person, or a relative within the meaning of section 383(1), points 1 to 3, of the Code of Civil Procedure, to the risk of criminal prosecution or of proceedings under the Regulatory Offences Act.
(3) The resolution authority is not obliged to reimburse the persons concerned for costs and expenses incurred as a result of applying this provision.
