(1) Where the management body of a group entity domiciled in Germany intends to provide intragroup financial support, it must notify this in writing, before the support is provided, to the following authorities:
1. the supervisory authority,
2. the consolidating supervisor,
3. the supervisory authority of the undertaking intending to receive the financial support, and
4. the European Banking Authority.
(2) The notification under subsection (1) must contain the following particulars:
1. the reasoned decision of the management body,
2. detailed particulars of the intended provision of financial support,
3. a comprehensible presentation of the consideration determined on the basis of the principles for determining and calculating it set out in the intragroup financial support agreement, and
4. a copy of the intragroup financial support agreement.
(3) Where the supervisory authority is at the same time the consolidating supervisor of the undertaking notifying its intention to provide financial support, it informs the other members of the supervisory college and the members of the resolution college of the notified intention without delay.
