(1) Where the resolution authority becomes aware, from another body, of a possible failing or likely to fail, it examines without delay whether the conditions for a failing or likely to fail are satisfied. Where the resolution authority becomes aware of a possible failing or likely to fail from a body within the meaning of section 138(3), second sentence, points 1 to 4, that body is obliged to provide the resolution authority, fully and without delay, with all information concerning the possible failing or likely to fail.
(2) The resolution authority documents the outcome and the principal considerations of the examination under subsection (1), and the further course of action planned.
