(1) The independent expert valuer (valuer) must be independent of 1. State bodies, including the resolution authority, 2. the institution or group entity, and 3. the recipient legal entity, where applicable. The independence of the valuer required to carry out a definitive valuation is not precluded merely because the valuer has already been involved in the resolution authority's provisional valuation of the assets and liabilities of the institution or group entity.
(2) The valuer is appointed by the resolution authority. The valuer receives appropriate remuneration, the amount of which is determined by the resolution authority, and is reimbursed for necessary expenses. The requirements for the valuer's independence are determined by Articles 37 to 41 of Regulation (EU) 2016/1075.
