Limitation of liability

By way of derogation from section 75(1), first sentence, of the Federal Civil Servants Act, civil servants whose authorities are required to perform functions under this Act are liable to make good damage they have caused in performing functions incumbent on their authority under this Act only where they have intentionally breached the duties incumbent on them. The first sentence applies correspondingly to public office holders who are not civil servants, including public-sector employees under collective agreements.
